Ride the Teal Waiver

LIABILITY WAIVER/ RELEASE AGREEMENT Ride the Teal Wave for Ovarian Cancer: Paddling for a Cure on Bellingham Bay September 3, 2023

I understand that signing this document will prevent me, my heirs, executors, dependents, beneficiaries and assigns from suing STAAR Ovarian Cancer Foundation (STAAR OC), Ride The Teal Wave, its officers, directors, volunteers or advisers for any injuries including death or damages that I might receive while participating in this event.

1. I assume all risks and agree to wear a personal flotation device (PFD) while on the water.

• I recognize the risk of serious injury, death or other damages inherent in water sport activities and in participation related to these activities. There is no way to completely eliminate the risk of serious injury or death in an aquatic environment. I understand the risk of serious injury, death or other damages inherent in water sport activities. I knowingly and voluntarily assume all risks, whether known or unknown, of injury, illness (including communicable disease such as COVID-19), death or damage of whatever kind arising out of my participation.

2. I waive and release all claims.

• I agree to release STAAR OC and Ride The Teal Wave for all claims, damages or causes of action of any kind whatsoever including but not limited to any claims of negligence which may arise as a result of my participation in this event.

3. I will hold harmless and indemnify STAAR OC and Ride The Teal Wave.

• I agree to defend, protect, indemnify and hold harmless STAAR OC and Ride The Teal Wave, its officers, directors, volunteers and advisers from and against any and all claims, suit, actions at law or in equity for damages or other relief and against any liability for any nature that may arise out of my participation in this event. I expressly agree not to sue the STAAR OC and Ride The Teal Wave or anyone associated with this event and hereby waive all claims and liabilities against STAAR OC and Ride The Teal Wave and those parties without limitation including claims for negligence arising from my participation in this activity for I agree to abide by the rules.

4. I am eighteen (18) years of age or older, or the parent or legal guardian of a minor participating in this event.

• I am legally competent to sign this release. I understand these terms are contractual and not mere recital, and that I have signed this document as my own free act.

I hereby WAIVE, DISCHARGE CLAIMS, AND RELEASE STAAR Ovarian Cancer Foundation and Ride The Teal Wave, its officers, directors, trustees, employees, agents, and event leaders (“Releasees”) from any and all liability on account of injuries, even if caused by negligence, in any way connected with this event. I further agree to DEFEND, INDEMNIFY, and HOLD HARMLESS the Releasees from any claims, damages, injuries or losses caused by negligence or my own conduct or actions while a participant on this event. I understand and intend that this RELEASE FROM LIABILITY AND ASSUMPTION OF RISK is binding upon my heirs, executors, administrators and assigns.
